Nhadep.cz sincerely thanks you for choosing us as your partner for your interior design project. To ensure a smooth, transparent, and efficient collaboration while minimizing misunderstandings or unnecessary disputes, we kindly ask that you carefully read the following Terms & Conditions.
A. Definitions and Terminology:
1. Abbreviations and Definitions
Party A: refers to the individual, organization, property owner, or authorized representative who engages Nhadep.cz to provide interior design services. Party A is responsible for providing complete and accurate project information, communicating design requirements, and fulfilling all payment obligations as agreed.
Party B: refers to Nhadep.cz, the interior design service provider. Party B is responsible for consulting, developing, and delivering the agreed design package within the agreed scope, timeline, and quality standards.
Interior Design: is the process of developing design concepts and producing technical drawings for interior spaces, including space planning, furniture layout, color schemes, material selection, and design aesthetics, with the objective of creating residential or commercial environments that satisfy the client's functional requirements, aesthetic preferences, and personal identity.
Architectural Design (Exterior Design): refers to the design of a building's exterior appearance and overall form, including but not limited to:
Building façade
Roof design
Balconies
Overall proportions and massing
Architectural style (modern, classical, local, etc.)
Site organization, including entrances, porches, gardens, and outdoor spaces
Placement of windows, doors, exterior walls, and landscape features
Architectural design is typically the first stage of a new construction or major renovation project and is not included in the scope of interior design services unless otherwise agreed.
Structural Design: is the engineering process of designing the building's load-bearing system to ensure structural safety and compliance with engineering standards. This includes:
Foundations
Columns
Beams
Floor slabs
Load-bearing walls
Structural calculations
Material specifications (concrete, steel, etc.)
Structural design is normally carried out by licensed structural engineers and is outside the scope of the interior design services provided by Party B.
M&E Design (Mechanical & Electrical Engineering): refers to the engineering design of the building's technical systems, including:
Mechanical Systems
Air conditioning and HVAC
Ventilation
Water supply
Drainage
Pumps
Elevators
Electrical Systems
Lighting
Power distribution
Electrical outlets and switches
Electrical panels
Internet and networking
CCTV
Audio systems
Security systems
Smart home systems
Professional M&E design requires specialized engineers and is an essential component of medium and large-scale construction projects.
The interior design service provided by Party B only coordinates the locations of lighting fixtures, switches, and outlets where necessary and does not replace a professional M&E design package.
Design Supervision (Author's Supervision): is the process by which the designer monitors and provides professional guidance during construction to ensure that the completed work follows the approved design intent.
This service may include:
Explaining drawings to the contractor
Recommending alternative materials or solutions when site conditions differ from the design
Reviewing construction work for deviations from the approved drawings
Design supervision is strictly advisory in nature. It does not authorize Party B to stop construction, issue construction instructions, or alter engineering methods.
Construction Supervision: is the professional management and inspection of construction activities to ensure compliance with:
- Engineering standards
- Approved construction methods
- Project schedule
- Material specifications
- Approved construction drawings
Construction supervision is normally carried out by qualified engineers or construction supervisors who are directly responsible to the project owner and, where applicable, the relevant authorities. Unlike design supervision, construction supervision has the authority to:
- Require construction work to stop
- Request corrective actions
- Reject work that fails to meet required standards
2. Layout và Concept
- Layout is a two-dimensional (2D) space planning drawing showing the arrangement of rooms, furniture, circulation paths, doors, walls, and other functional elements. Examples include: Bed placement, Kitchen layout, Furniture arrangement, Walking circulation,...
- Concept is the overall design direction of the project, including: Interior design style (Modern, Japandi, Neoclassical, etc.), Color palette, Proposed materials, Overall design inspiration.
Purpose: To help the client visualize and approve the overall design direction before detailed development begins.
3. 3D Visualization
- A 3D Visualization is a computer-generated representation of the proposed interior design.
- It realistically illustrates: Space planning, Lighting, Colors, Materials, Furniture, Decorative elements
Purpose: To help the client clearly understand and experience the completed design before construction begins.
4. Technical Drawing Package
- The Technical Drawing Package consists of detailed 2D construction drawings used for interior construction and manufacturing.
- It typically includes: Furniture layout plans, Reflected ceiling plans, Wall elevations, Custom furniture details, Electrical layout showing outlets, switches, lighting fixtures, and related items
Purpose: To serve as the technical reference for contractors and manufacturers, ensuring that the project is built according to the approved design.
5. Administrative and Legal Procedures
- Administrative and legal procedures refer to approvals or legal requirements associated with renovation, remodeling, or construction work.
Examples include:
+ For apartments or condominiums: Approval from the building management before construction begins.
+ For houses or larger projects: Building permits, Renovation permits, Completion approvals, Fire safety compliance, Other statutory requirements
Important Notice: The services provided by Party B do not include obtaining permits, preparing legal documentation, or handling administrative procedures. Party A is solely responsible for arranging these matters directly or through qualified third-party consultants.
B. Terms & Conditions of Service
1. Scope of Interior Design Services
Included Services:
- One (1) complimentary on-site survey and measurement.
- Development of the 2D furniture layout plan (Layout) with unlimited revisions until approved by Party A.
- Development of the 3D design concept and visualizations for all agreed spaces after one (1) layout option has been finalized.
- Preparation of the technical construction drawing package (2D), including floor plans, ceiling plans, wall elevations, and custom furniture drawings after the 3D design has been approved.
Excluded Services: Unless otherwise agreed in writing, the design service does not include:
- Architectural (exterior) design.
- Structural engineering design.
- Mechanical, Electrical & Plumbing (M&E/MEP) engineering design.
- Detailed quantity take-offs, cost estimation, or tender documentation.
- Building permits, renovation permits, or any legal and administrative procedures related to the project.
- Design supervision (Author's Supervision) during construction.
- Construction supervision or site management.
Note: Any services outside the above scope may be added through a written contract addendum and will be subject to additional fees.
2. Project Schedule
The estimated project schedule varies depending on the scope of each project and will be clearly stated in the Quotation.
The project timeline may be extended under the following circumstances:
- Party A requests multiple or substantial design revisions.
- Delays caused by Party A, including but not limited to: Delayed approvals; Failure to reach internal decisions; Legal or administrative issues; Any other circumstances beyond Party B's control.
- Delays caused by Party B. In such cases, Party B will notify Party A in writing, and both parties will mutually agree on a revised schedule.
3. Project Deliverables
3.1. 2D Furniture Layout Plan (Layout)
A two-dimensional layout drawing showing: Overall space planning, Furniture arrangement, Furniture dimensions, Circulation clearances, Door locations, Walls and partitions, Other architectural elements relevant to the interior layout.
3.2. 3D Interior Visualization
High-quality computer-generated renderings provided in JPG or PNG format. The renderings illustrate:
- Interior colors
- Materials and finishes
- Lighting
- Furniture
- Decorative accessories
- Overall atmosphere of the space
Each room (for example, the living room, kitchen, or bedroom) typically includes two to three viewing angles.
3.3. Technical Construction Drawing Package
A comprehensive set of technical drawings for interior construction, including:
- General furniture layout plan
- Ceiling plans
- Wall elevations
- Floor finish plans
- Detailed custom furniture drawings (wardrobes, cabinets, beds, kitchens, shelving, etc.)
- Layouts showing the locations of electrical outlets, switches, lighting fixtures, CCTV cameras, Wi-Fi equipment, and heating devices.
Deliverables will be provided in PDF format. AutoCAD (DWG) files may be provided only if specifically agreed upon in writing.
3.4. Items Not Included in the Design Package
Unless separately agreed, the following items are not included:
- Original editable design files (AutoCAD, SketchUp, 3ds Max, Photoshop, or other source files).
- Architectural (exterior), structural, or M&E engineering drawings.
- Detailed construction cost estimates or contractor quotations. If Party A requires construction pricing, this service must be provided separately by Party B or an independent contractor.
- Design supervision, construction supervision, site coordination, or contractor management during construction. These services may be provided under a separate agreement if requested.
- Animation videos, photorealistic walkthroughs, or renderings incorporating real people or real-site photo compositing.
4. Design Revisions
To ensure an efficient workflow, design revisions are governed by the following policy:
- Layout & Concept Stage: Party A may request unlimited revisions to the Layout and Design Concept until they are approved.
- 3D Visualization Stage: Party A is entitled to up to two (2) rounds of revisions at no additional charge. Complimentary revisions are limited to changes involving: Furniture shapes and forms, Interior materials and finishes, Colors, Decorative elements.
The complimentary revision policy does not include changes to the approved furniture layout, space planning, or room arrangement. Any request to modify the approved layout after the 3D stage has commenced will be treated as additional work and may incur extra charges.
- Technical Drawing Stage: Once the 3D design has been approved and Party B has begun preparing the technical construction drawings, no complimentary revisions are included.
Should Party A request additional changes at this stage, Party B will provide a quotation for the additional design fee together with the revised delivery schedule before proceeding.
5. Intellectual Property and Copyright.
- Party B shall retain the copyright and intellectual property rights to all design documents permanently unless otherwise agreed in writing.
- Upon full payment of all agreed fees, Party A is granted a non-exclusive license to use the design solely for the project for which it was commissioned.
- Party A may not reproduce, modify, resell, transfer, or use the design for other projects without the prior written consent of Party B.
6. Common Risks and Resolution Procedures:
Common Situations:
The following situations may result in the temporary suspension or permanent termination of the design project:
- Party A voluntarily requests to suspend or permanently terminate the project for reasons attributable to Party A. Any temporary suspension may not exceed three (3) months from the date Party A provides written notice.
- Party A remains dissatisfied after numerous design revisions. If five (5) consecutive major revisions have been carried out without reaching approval, Party B reserves the right to terminate the project.
- Party A and Party B are unable to reach mutual agreement on the proposed design solution.
- Party A fails to provide feedback or delays approval. If Party A does not respond within thirty (30) days after receiving the deliverables for any project stage, Party B reserves the right to terminate the project.
- Party A requests additional services beyond the agreed scope, and both parties cannot reach an agreement regarding the additional fees.
Resolution and Design Fee Calculation:
- If the project must be suspended or terminated for any of the reasons listed above that are attributable to Party A, the design fee payable shall be calculated as follows:
Scenario 1: Site survey completed, and the Layout is being developed or revised:
Fixed service fee: CZK 5,000
Plus 25% of the total contract value
Scenario 2: The Layout has been approved, and the 3D design is being developed or revised:
Fixed service fee: CZK 5,000
Plus 65% of the total contract value
Scenario 3: The 3D design has been approved, and the technical construction drawings are being prepared:
Fixed service fee: CZK 5,000
Plus 85% of the total contract value
If Party A later decides to resume the same project, all fees paid under the above scenarios will be credited toward the restarted project. All previously agreed Terms & Conditions shall continue to apply. However, if more than twelve (12) months have elapsed since the original project commencement date, Party A and Party B shall renegotiate the total design fee before restarting the project to reflect inflation, market conditions, and changes in service costs.
- If the project is suspended or permanently terminated due to reasons solely attributable to Party B, Party B shall refund 100% of the advance payment received from Party A.
7. Validity and Binding Effect.
This document forms an integral part of the cooperation between Party A and Party B. By engaging Party B's design services, paying the required deposit, or confirming the commencement of the project, Party A acknowledges that they have read, understood, and accepted all Terms & Conditions contained in this document. In the event of any misunderstanding or dispute arising during the project, this document shall serve as the primary reference for determining the rights and obligations of both parties, with the objective of ensuring fairness, transparency, and good faith throughout the resolution process.
C. Benefits of Having a Professional Interior Design Package
Interior design is a structured and purposeful process of shaping an interior environment based on the client's functional requirements, lifestyle, and personal preferences. It involves carefully planning the layout, selecting materials, designing lighting, and creating a cohesive aesthetic. More than simply helping clients visualize the finished space, a complete design package serves as a comprehensive guide for construction.
A well-prepared interior design package provides numerous practical benefits, including:
- Clear Visualization Before Construction
- A Reliable Basis for Construction Pricing and Quality Control
- Saving Time, Money, and Unnecessary Rework
- Reducing Misunderstandings Between All Parties
- Improving Project Efficiency and Maintaining a Positive Working Environment
